After House Bill 189 passed its preliminary review with the House Industries and Professional Activities Subcommittee, Florida’s efforts to modernise its gambling laws have gained fresh impetus.
HB 189, which is almost 100 pages long, is the most comprehensive attempt in years to modernise, unify, and clarify the state’s complicated gaming laws.
When the 2026 session of the legislature starts in January, the bill will be brought back for additional consideration.
Recent developments, including the high-profile arrest of NBA player Terry Rozier in a sports betting probe, have highlighted lawmakers’ concerns over match-fixing and betting integrity.
In response, HB 189 outlines a unified enforcement framework, criminalising a host of manipulative behaviours — placing or accepting bets with knowledge of a fixed contest, bribery connected to games, and participation in conspiracies to alter sporting outcomes.
In order to give regulators more power to deal with threats to sports integrity, the proposal establishes new felony charges for such offences.
Focus on Sports Integrity, Fantasy Sports, and Enforcement
One of the most important parts of HB 189 gives daily fantasy sports (DFS), which has operated in Florida’s legal limbo, a solid legal basis.
The proposed law prohibits college athletes from participating in fantasy competitions, requires the use of simulated teams with multiple players, and prohibits the use of single-player performances or final scores.
Operators of single-player ‘pick’em’ products might have to change offerings or leave the market in order to comply, but entry fees would be allowed.
The bill also addresses the widespread use of illicit slot machines in small businesses and retail establishments.
In response to state regulators’ demands for more substantial deterrents, HB 189 aims to make some offences felonies and allow law enforcement to seize illicit machines, even though the current penalties are still minor misdemeanours.
Law enforcement officials clarified during committee hearings that harsher penalties are essential for efficient oversight.
To make sure that charitable fundraising games are not unintentionally impacted, a number of community and veteran organisations have asked for clarification.
Rep. Dana Trabulsy, the bill’s sponsor, has stated that she is collaborating with interested parties to improve the text.
Following subcommittee approval, the Commerce and Criminal Justice Committees will take up HB 189.
Florida lawmakers are anticipated to revisit important issues in the next legislative session, such as regulations governing sports betting, the extent and licensing of daily fantasy sports, stronger enforcement priorities, and the most effective ways to promote charitable gaming under the updated legislation.
