
A new class action lawsuit has been filed in federal court in Ohio against sweepstakes casino operator Stake.us, accusing the company of running an illegal online casino.
The suit names the sweepstakes giant over its US-facing platform and challenges the legality of its business model under Ohio gambling law.
According to the complaint, Stake.us is described as “an online version of an Internet Cafe,” using the same underlying structure that courts have previously scrutinised in brick-and-mortar sweepstakes cafe cases.
The complaint says that the site uses a 1:1 pricing model, like those earlier operations. This is an important point in the case for saying that Stake.us is an illegal casino instead of a legal promotional sweepstakes.
Growing Legal Pressure on Sweepstakes Casinos
The new Ohio case comes amid a broader wave of litigation targeting sweepstakes-style casino platforms across the United States.
In recent years, plaintiffs in states including Alabama, Illinois, Minnesota, and California have brought actions alleging that Stake.us and comparable operators are effectively offering real-money gambling without the required licenses by bundling purchasable virtual coins with the ability to win redeemable prizes.
Some of these lawsuits are based on old “gambling loss recovery” laws or consumer protection laws that let players get their money back for losses because of illegal gambling schemes.
In some complaints, Stake.us is accused of marketing itself as a free-to-play or social casino while enabling users to purchase tokens that can be used on casino-style games and, if successful, converted back into money or other things of value.
The Ohio class action adds to this mounting legal scrutiny and focuses specifically on how sweepstakes-style pricing models and dual-currency systems operate under that state’s gambling framework.
The case will test whether an online sweepstakes casino with a 1:1 purchase structure can be treated in the same way as earlier internet cafe setups that courts have found to constitute illegal gambling.
